Article I
|
|
|
Name |
|
|
Section 1.
|
The name of the organization shall be: The Pastoral Council of St. Mark Fallston, Roman Catholic Congregation,Inc. |
|
|
|
|
|
Article II
|
|
|
Purpose |
|
|
Section 1.
|
The purpose of the Pastoral Council is: |
|
|
a.
|
To be a visible witness to all people of the message and service of our
Lord Jesus Christ; |
|
|
|
To act as a legitimate representative voice of the people of the parish of St. Mark, lay religious and clerical - to the Pastor; |
|
|
|
To provide an open and honest forum of communication and dialogue regarding parish affairs; |
|
|
|
To encourage by all available means a vigorous and effective lay apostolate; |
|
|
e.
|
To collaborate with other religious bodies and with civic business and professional organizations in serving the common good of the community; |
|
|
f.
|
To assist the Pastor in his administration of the parish through recommendations and active cooperation in the setting of policy for the parish; |
|
|
g.
|
To accept responsibility with the Pastor for the life and mission of the Church in the parish; |
|
|
h.
|
To participate by active cooperation with the Regional Council and with the Archdiocesan Pastoral Council, in the total life and mission of the Church within the archdiocese. |
|
|
|
|
|
|
Section 2 Pursuant to the purpose set forth in Section 1 of this Artical, counsil
|
|
|
shall perform the following functions as recommendations to the
pastor.
a. It shall periodically review the statement of the parish's mission
b. It shall render to all parishioners from time to time, but at least annually, a report of the parish's spiritual, material, and financial condition.
Article III
|
|
|
Operation |
|
|
Section 1.
|
The Council shall submit its recommendation to the Pastor in the form of conclusion resulting from the considered reflection and discussion by Council members within two weeks after the Council meeting. |
|
|
|
|
|
Section 2.
|
If the Pastor, for grave reasons, such as fidelity to the Gospel, obedience to the Church or civil law, or other serious financial or administrative considerations, cannot in good conscience accept and/or carry out the recommendations of the Council, he shall fully and frankly communicate his reservations with regard to them to the assembled Council. If the Pastor does not communicate such reservations at the next regularly scheduled meeting of the Council following the date on which the recommendations were submitted to him, the Council shall be entitled to presume their acceptance. |

|
Section 3. |
Upon notification from the Pastor that he has reservations about the Council's recommendations, the Pastoral Council, after discussion and reconsideration, may vote whether to sustain its original position or not. If the number of votes to sustain is less than two-thirds majority of the voting council members, the recomendation shall fail. if two-thirds majority vote to sustain its original position and the Council and the Pastor are unable to resolve the situation, either the Pastor or the Council through it's president, may refer the matter to the Ordinary for such action as he may deem fitting. |

Article IV
|
|
|
Members |
|
|
Section 1.
|
|
|
|
a.
|
The Pastor and the Corporators shall be automatic non-voting members of the Council and shall have full voice in its deliberations. |
|
|
b.
|
The immediate Past President shall serve, in an ex-officio position, for a one year term and shall have full voice in its deliberations, but shall have no vote unless finishing an elective term. |
|
|
|
|

|
Section 2.

The voting members of the Pastoral Council shall consist of the following:
The chairpersons, or the designated representatives, of the Standing Committees.
A representative of or from the Youth, appointed by the Pastor and the President of the Council.
Nine (9) Members-at-large who shall be members 18 years of age or older, elected by the parish by annual balloting.
The Pastor may name no more then three lay persons to be appointive members, and such appointive members shall serve for the same term of office as the elective members of the Council to which they are appointed. Such appointments shall endeavor, so far as is practial, to achieve a proper balance among sexes, ethnic groups, age groups, and areas of knowledge and competence desired on the Council.

Section 4.
|
|
|
|
a.
|
All elected Members-at-large shall serve a three (3) year term unless appointed to fill a vacancy and shall not be elected to more than two (2) consecutive terms.
|
|
|
b.
|
The Youth Representative shall be appointed for a period of one (1) year. |
|
|
c.
|
The Harford Regional Council delegates shall be appointed from among the voting members of the Pastoral Council. |
|
|
d.
|
Any vacancies occurring among the said Members-at-large shall be filled by the next highest runner-up in the last election who shall serve for the remainder of the unexpired term. In the event of a tie, the selection shall be made by a drawing. If there is no remaining runner-up, the Executive Committee in consultation with the Pastor shall propose at the next Pastoral Council meeting the names of at least two (2) parishioners who have been contacted and agreed to serve if elected. The Pastoral council shall elect one of the persons so proposed to fill the vacancy by a majority vote. |
|

|
Any member with two (2) unexcused absences from Parish Council meetings in any 12 month period may be asked to resign. The President of the Council, after consulting with the Pastor, shall bring such cause for resignation before the next Executive Committee meeting which shall decide be a majority vote whether to call for such a resignation. |
|
|
|
|
|
Article V
|
|
|
Officers |
|
|
Section 1.
|
The Officers shall consist of the President, Vice President, Recording Secretary and Corresponding Secretary. |
|
|
|
|
|
Section 2.
|
The officers shall be elected by and from voting members of the Pastoral Council by a simple majority vote at a meeting in June. The outgoing president shall chair the June meeting until the new President is elected. Upon election, the new President shall assume the chair and direct the proceedings for the election of the remaining officers. The outgoing Recording Secretary shall record the munites of the entire June meeting.

|
|
Section 3.
|
The term of office for each elected officer shall be for one (1) year, starting in June. |
|
|
|
|
|
Section 4.
|
No officer shall be eligible for election for more than three (3) consecutive terms in the same office. |
|
|
|
|
|
Section 5.
|
In the event of a vacancy in any office, it shall be filled by a special election held at the next meeting. |
|
|
|
|
|
Article VI
|
|
|
Executive Committee |
|
|
Section 1.
Section 2
|
The Executive Committee shall consist of the President, Vice President, Recording Secretary, Corresponding Secretary, the Immediate Past President and the Pastor.
The Executive Committee shall meet between the Pastoral Council meetings or upon notice given by President or Pastor.
|
|
|
|
|
|
Section 3.
|
The Executive Committee shall prepare the agenda for the Council meeting and handle any emergency matters coming before the Council in between its meetings. Any action taken in the name of the Councilshall be reported at the next meeting. |
|
|
|
|
|
Section 4.
|
The Executive Committee shall abide by the previous decisions of the Parish Council and take no action contrary thereto. |
|
|
|
|
|
Section 5.
|
Four (4) members shall constitute a quorum for conducting business. |
|
|
|
|
|
Article VII
|
|
|
Committees |
|
|
Section 1.
|
The standing Committees shall be: Faith Formation Board, Finance, Liturgy, Maintenance, Parish/ Community Outreach, each acting in such areas and with such powers as may be delegated to it by the full Council. |
|
|
|
|
|
Section 2.
|
The Chairpersons of the Standing Committee shall be appointed by the Pastor and presented to the Council. The Pastor shall also be consulted in all other committee appointments when it is appropriate. |
|
|
|
|
|
Section 3.
|
Each Member-at-large and the Youth Representative (except officers) shall participate on one of the committees or in some othe parish ministry, having regard for the knowledge and competence desired in each activity. |
|
|
|
|
|
Section 4.
|
The Chairperson of each Standing Committee, in consultation with the President, shall be free to name to that committee parishioners who are not members of the Council in order to provide the breadth and depth which the work of the committee requires. |
|
|
|
|
|
Section 5.
|
The Chairperson shall have the authority to call meetings of that committee as often and at such times as in her/her judgment may be necessary, and shall submitt to the Council a written report on the work of the Committee after each Committee meeting. |
|
|
|
|
|
Section 6.
|
The President, in consultation with the Pastor, shall have the authority to create any special or temporary committees which may from time to time be deemed necessary and to designate the members thereof. |
|
|
|
|
|
|
|
|
Article VIII
|
|
|
Election of Members - at - Large |
|
|
Section 1.
|
Any lay person who has attained to the age of 18 years by the date of election, and who is a registered member of the parish with good standing, shall be eligible for election to the council, and all persons meeting these same qualifications shall likewise be eligible to vote in such elections. |
|
|
|
|
|
Section 2.
|
The President, at the general meeting held in the month of January, shall appoint a nominating committee and designate the chairperson thereof; the committee shall identify qualified parishioners and obtain their consent to run as candidates of the council. The nominating committee, at the March or April meeting, shall present the list of nominees for approval of the Council. The number of candidates shall be at least equal to twice the number of elective seats on the council to be filled. |

|
|
Section 3.
|
Elections shall be held on the third Sunday of May. They shall be by secret ballot which shall be distributed to all eligible parishioners and the persons receiving the highest number of votes on their returned qualified ballots shall be declared elected to fill those seats vacant on the council. In the event of a tie, the President and the Pastor will toss a coin of choice by lot to determine the winner form among the candidates involved. |

|
Section 4.
|
The newly elected council members shall take office at the first meeting in June. |
|
|
|
|
|
Article IX
|
|
|
Meetings |
|
|
Section 1. |
The Pastoral Council shall meet at least eight (8) regular meetings and such special meetings as are deemed necessary. |
|
|
|
|
|
|
|
|
Article X
|
|
|
Amendments |
|
|
Section 1.
|
This constitution may be amended at any regular meeting of the Council by a two-third majority of the total voting membership. Provided that there shall have been appended to the call of the meeting a copy of the proposed amendment. |
|
|
|
|
|
|
|
|
|
|
|
|
|
|

Article I
|

Section 1.

The Pastoral Council shall meet at least eight (8) times annually in the months of September, October, November, January, February, March, April May and June.
The Pastor, the President, or any five (5) members of the Council may call a special meeting of the Pastoral Council by giving written notice of the special meeting and its purpose to all members of the Pastoral Council at least three (3) days proir to the date thereof.

Section 3. |
Quorum: The presence of the two-third (2/3) of the voting members of the Pastoral Council shall constitute a quorum.
|
|
|
Section 4. |
Notice to all regular meetings together with the Agenda shall be sent, in writing, to all members of the Pastoral Council in advance of the meeting. In addition, notice of the pending meeting shall be given to the general Parish in the Parish Bulletin. |
|
|
|
|
|
Article II
|
|
|
Duties of Officers |
|
|
Section 1. |
President |
|
|
|
It shall be the duty of the president: |
|
|
a.
|
To uphold the Constitution of the Pastoral Council; |
|
|
b.
|
Together with the Pastor, to keep the Pastoral Council informed of all Parish affairs; |
|
|
c.
|
To preside at all meetings; |
|
|
d.
|
To make all executive appointments; |
|
|
e.
|
To cause sufficient notices to be sent as prescribed in Article I of the By-Laws; |
|
|
f.
|
To cause to be furnished to the Pastor one (1) copy of the minutes of all meetings. |
|
|
|
|
|
Section 2. |
Vice - President |
|
|
|
It shall be the duty of the Vice - President: |
|
|
a.
|
To assist the President; |
|
|
b.
|
In the President's absence or resignation, to fulfill the duties of the President. |
|
|
|
|
|
Section 3. |
Recording Secretary |
|
|
|
It shall be the duty of the Recording Secretary: |
|
|
a.
|
To record and to reduce to writing the minutes of all meetings; |
|
|
b.
|
To preserve in volume the minutes of all meetings, said volume to be presented to the board of Coporators annually; |
|
|
c.
|
To assist the Corresponding Secretary in the performance of his/her duties. |
|
|
|
|
|
Section 4. |
Corresponding Secretary |
|
|
|
It shall be the duty of the Corresponding Secretary: |
|
|
a.
|
To give notice of all meetings to the Pastor, Lay Corporators and members of the Pastoral Council and to the general Parish in the Parish Bulletin on the weekend preceeding the the meeting; |
|
|
b.
|
To handle all outgoing correspondence called by the President and the Pastoral Council; |
|
|
c.
|
To assist the Recording Secretary in the performance in his/her duties. |
|
|
|
|
|
Article III
|
|
|
Spiritual Advisor |
|
|
Section 1.
|
The Pastor, or his designee, shall act as the spiritual advisor to the Pastoral Council |
|
|
|
|
|
Article IV
|
|
|
Fiscal Policy |
|
|
Section 1.
|
The Pastoral Council shall have no treasury and shall have no fund raising powers |
|
|
|
|
|

Section 2.
|
The Executive Committee at their agenda setting meeting may amend the Order of Business. |

Article VI
|
|
|
Meeting Procedures |
|
|
Section 1.
|
All resolutions to be voted upon shall be submitted to the President in writing. |
|
|
Section 2.
|
A two thirds (2/3) majority will be necessary to carry out any motion, except as specified in the Constitution. |
|
|
Section 3.
|
The rules contained in the current edition of Robert's Rules of Order shall govern the Pastoral Council in all cases to which they are applicable and in which they are not inconsistent with the Constitution and any special rules of order the Pastoral Council may adopt. |
|
|
Section 4.
|
The President of the Pastoral Council may appoint, a parliamentarian, who need not be a member of the Pastoral Council, to assist and advise in presiding at all meetings. |
|
|
|
|
|
Article VII
|
|
|
Amendments |
|
|
Section 1. |
Amendments to these By - Laws shall require for their adoption a two-thirds (2/3) majority. |
